1. Introduction

Welcome to Gabus Safari Lodge, operated by Gabus Lodge And Safaris cc (“we”, “us”, “our”). These Terms & Conditions apply to your use of our website at gabusnamibia.com and to all bookings and stays with us. Together with our Privacy Policy, they form your agreement with us.

By making a booking or using this website, you confirm that you have read, understood and agree to these Terms. If you do not agree, please do not book or use the website. Contact us through our contact page and we will try to find a solution.

2. Bookings

Bookings must be made by a person aged 18 or older with the legal right to enter into this agreement. A booking is confirmed only once we have received the required deposit and sent you a written confirmation.

You confirm that the information you give us is true, correct and complete. We may refuse or cancel a booking if there is an error in the rates or availability, an error in your booking, or if we suspect fraud or an unauthorised or illegal transaction.

3. Deposit and Payment

A 100% deposit is required to confirm a reservation with Gabus Safari Lodge. Payments are processed through Adumo Online, a Lesaka Technologies company and a trusted South African payment gateway. Your card details are entered on Adumo’s secure payment page and are never stored by Gabus Safari Lodge under any circumstances.

You confirm that you have the legal right to use the card or payment method you provide. Rates are quoted in [NAD / ZAR / USD] and payments are processed in [currency]. Your bank may charge additional fees or exchange-rate differences.

4. Cancellations and Changes

Refunds for cancellations are calculated on the number of days between the date we receive your written cancellation and your arrival date:

• 31 days or more before arrival: 90% refund. A 10% handling fee applies to cover our payment gateway costs.
• 16 to 30 days before arrival: 50% refund.
• 11 to 15 days before arrival: 25% refund.
• 10 days or less before arrival, or no-show: no refund (0%).

No refunds are given for late arrival or early departure.

All cancellations and change requests must be submitted to us in writing through our contact page. Date changes are [subject to availability and may be treated as a cancellation and new booking / permitted once free of charge up to ___ days before arrival].

5. Refunds

Refunds are issued only in accordance with our cancellation terms above, within 30 (thirty) days of the day we receive your refund request. It may take longer for the money to reach your bank account, particularly for international transfers. Please give us all the information we need to complete the refund.

6. Force Majeure

We are not liable for cancellations or disruptions caused by events beyond our control, such as severe weather, road closures or government restrictions. We will offer a date change or credit where possible.

7. Check-in, Check-out, Children and Pets

Check-in is from 14:00 and check-out is by 10:00. Please tell us if you expect to arrive after 18:00. Parents and guardians must supervise their children at all times. Pets are not permitted.

8. Indemnity and Activities

An indemnity form must be signed by every guest, and by a parent or guardian for each child, before taking part in any activity. Guests who do not sign may not be able to take part.

All activities are subject to availability, weather and safety conditions, and may be changed or cancelled without notice.

9. Stay at Your Own Risk

Guests stay at the lodge and take part in all activities at their own risk. Gabus Lodge And Safaris cc, trading as Gabus Safari Lodge, its owners, managing members, management and staff accept no liability for injury, illness, death, loss, theft or damage to persons or property, however caused, to the fullest extent permitted by law.

Guests are responsible for their own belongings. Wildlife is wild and unpredictable, so please follow staff instructions and safety guidelines at all times. We strongly recommend travel insurance covering cancellation and medical costs.

10. Damages

Guests are responsible for any damage to lodge property caused by them or their party during their stay.

11. Communications

We may use your contact details to reply to your enquiry and to manage your booking. We will send you newsletters or promotional material only if you have agreed to receive them. You can opt out at any time using the unsubscribe link or by contacting us through our contact page.

12. Website Use, Copyright and Intellectual Property

The website, its content, photographs, logos and trademarks belong to Gabus Lodge And Safaris cc or are used with permission. You may not copy, distribute, modify or reuse them for commercial purposes without our prior written permission.

You agree to use the website only for lawful purposes. You may not use bots or automated tools to copy its content, attack or overload the site, introduce malicious code, attempt unauthorised access, or submit spam or fraudulent enquiries.

If you believe content on our website infringes your copyright, please tell us through our contact page with the subject “Copyright Infringement” and a description of the work and where it appears.

13. Spam Protection and Third Parties

Our forms are protected by Cloudflare Turnstile, which runs in the background to detect automated abuse. See the Turnstile Privacy Addendum.

Our website may link to third-party websites and services that we do not own or control. We are not responsible for their content, privacy policies or practices, and we encourage you to read their terms and policies.

14. Limitation of Liability

To the fullest extent permitted by law, we are not liable for indirect or consequential loss, or for any loss arising from the unavailability of our website. Nothing in these Terms excludes liability that cannot be excluded under Namibian law.

15. Changes to the Website and These Terms

We may amend or withdraw our website, services, rates or these Terms at any time by posting the changes on this site. The Terms in force when you make your booking apply to that booking. By continuing to use the website after changes are posted, you agree to the revised Terms.

16. Governing Law and General

These Terms are governed by the laws of Namibia. If any provision is found to be invalid or unenforceable, the remaining provisions stay in effect. Our failure to enforce a right is not a waiver of that right. These Terms are the entire agreement between us regarding our website and bookings.
